Robots Helper – Terms of Service

1. Acceptance of Terms
By accessing or using the services provided by RobotsHelper (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). These Terms apply to all visitors, users, and others who access or use the Service. If you do not agree to these Terms, you may not use the Service.
You represent that you are at least 18 years old and have the legal authority to enter into this agreement.
2. AI Nature of Service
RobotsHelper provides an AI-powered phone receptionist and dispatch service. While we strive for accuracy, AI technology may generate incorrect or unexpected information (“hallucinations”).
- No Warranty: RobotsHelper makes no guarantees regarding the accuracy, completeness, or reliability of the AI-generated information.
- User Responsibility: You are solely responsible for verifying all appointments, quotes, and customer details recorded by the AI.
- Limitation of Liability: RobotsHelper shall not be liable for any loss of revenue, reputation, or business opportunities resulting from AI errors, including incorrect scheduling, misquoted pricing, or unexpected AI behavior.
3. Call Recording & Legal Compliance
- Compliance with Law: You agree to use the Service in compliance with all applicable local, state, federal, and international laws, including telecommunications and call recording laws (e.g., ECPA, CIPA, GDPR).
- Consent: In jurisdictions requiring consent for recording calls (“Two-Party Consent” states), you are responsible for notifying callers that the call may be recorded. RobotsHelper provides features such as call announcements to assist compliance.
- Indemnification: You agree to indemnify and hold RobotsHelper harmless from any claims, damages, or legal fees arising from your failure to comply with applicable recording laws.
4. CRM & Third-Party Integrations
- Access: You grant RobotsHelper permission to access and modify data in third-party accounts necessary for the Service (e.g., ServiceTitan, Housecall Pro, Google Calendar, Calendly).
- Data Integrity: RobotsHelper is not responsible for data corruption, duplicate entries, or service interruptions caused by third-party API changes or outages.
- User Responsibility: You confirm that you have the right to share and allow RobotsHelper to process any data from third-party services.
5. Billing, Overages, & Setup Fees
- Subscription Fees: You agree to pay the recurring monthly fees associated with your plan ($497 for Core, $997 for Integrated) via the payment method on file.
- Setup Fees: Setup Fees ($499 for Core, $1,499 for Integrated) cover onboarding, scripting, prompt engineering, and calibration. These fees are non-refundable once onboarding begins.
- Overage Charges: Calls exceeding the plan limits are billed automatically: Core Plan: $1.50 per call over 300/month; Integrated Plan: $1.25 per call over 800/month.
- Automatic Payment Authorization: By using the Service, you authorize RobotsHelper to charge the payment method on file for recurring fees and overages.
- Failed Payment: RobotsHelper reserves the right to suspend or terminate the Service for failed payments.
6. Termination & Cancellation
- Cancellation by User: You may cancel your subscription at any time via the dashboard or by contacting support. Cancellation takes effect at the end of the current billing cycle.
- Termination by Company: RobotsHelper may terminate or suspend your account immediately, without notice or liability, for breaches of these Terms, illegal activity, harassment, spam, or misuse of the Service.
- Data After Termination: Upon termination, account and caller data will be handled according to the Privacy Policy.
- Survival: Provisions regarding liability, indemnification, and payment obligations survive termination.
7. Limitation of Liability
To the maximum extent permitted by law, RobotsHelper’s liability arising out of or related to the Service is limited to the total fees paid by you in the 12 months preceding the claim. RobotsHelper shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption.
8. Indemnification
You agree to indemnify, defend, and hold harmless RobotsHelper and its affiliates, officers, and employees from any claims, damages, liabilities, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.
9. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
- Any disputes arising from or related to these Terms shall be resolved in the state or federal courts located in California, USA.
- You agree to submit to the personal jurisdiction of such courts.
10. Modifications to Terms
We may update these Terms from time to time. Updated Terms will be effective immediately upon posting on our website or notifying you through your account dashboard. Continued use of the Service constitutes acceptance of the modified Terms.
11. Miscellaneous
- If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
- These Terms, together with the Privacy Policy, constitute the entire agreement regarding the Service.
